Statements allowed in murder trial

Most statements that teenage murder defendant Daniel Carter made to
investigators in the hours after his uncle was killed can be used at trial, Circuit Judge Terry Terrell ruled this week.
Detailed statements to Escambia County sheriff's homicide investigators that were videotaped after Carter waived his
constitutional rights - and his mother agreed he could be interviewed - can be presented as evidence, Terrell wrote in an order filed Thursday.
However, some "spontaneous" statements overheard or recorded by deputies at the crime scene after the distraught boy asked to be taken to Lakeview Center will be excluded.
In those statements, Carter is said to have admitted killing his uncle.
The ruling paves the way for Carter's trial on first-degree murder charges.
The trial is scheduled to begin within two weeks of his next court appearance, set for Tuesday.
Carter, 16, is charged with killing Jack Carter, 46, during a fight in July 2002.
Jack Carter went to the younger Carter's Beulah home that night at the request of his sister, Cindy Carter, a single mother who wanted him to discipline her son.
Daniel Carter cut Jack Carter 10 times with an antique machete, including a fatal 4-inch gash to his neck, sheriff's investigators said.
Daniel Carter maintains he was acting in self-defense against an uncle who struck him and threatened to castrate him.
Defense attorney Patrece Cashwell had filed a motion to exclude all of Carter's statements at trial, a move prosecutor David Rimmer opposed.
Homicide investigator Frank Fillingim has said that in Daniel Carter's statements to be admitted at trial, the teen seemed more angry that his uncle was damaging prized possessions during the confrontation than he was afraid of being hurt.
Pensacola New Journal Brett Norman has proven that he is an enemy to Daniel's case.
His story on the Motion to Suppress ruling by Judge Terrell (appearing in Saturday's issue) was so screwed up, you have to wonder where the hell he got his information?
Most of what he reported was just WRONG.
How could one person get so many things so wrong in one article?
Norman wrote:
* Statements were videotaped after Carter waived his constitutional rights.
WRONG! Transcripts from the hearing show that the videotaped session concluded with an investigator telling Daniel that he needed to sign the paper waiving his rights.
That means Daniel signed the waiver after, not before, the interview.
* His mother agreed he could be interviewed.
WRONG! His mother didn't even know about the interview.
Investigators lied to Daniel and told him that his mother was so emotionally distraught that she
couldn't help him. Transcripts of the hearing show that their pastor testitified that he heard no one identify themselves as homicide inversitgators or ask permission to interview/interrogate Daniel.
The pastor was at her side during the time investigators claimed they obtained her permission.
* Cindy wanted Jack to discipline her son.
WRONG!
This has been propagated by the investigators and reporters.
Daniel's mom asked Daniel's uncle to "talk" to him.
The decision to beat Daniel was Jack's and Jack's alone.
He had promised during a phone conversation 15 minutes before his arrival that he would not beat Daniel.
But he did.
* Daniel cut Jack 10 times with an antique machete.
WRONG!
The knife was old, but is characteristic of knives found in most kitchen drawers in any home - definitely NOT a machete.
* Frank Fillingim (investigator) has said that Daniel's seemed more angry that his uncle was damaging his prized possessions than he was afraid of being hurt.
WRONG!
The taped interview reveals that, even though investigators attempted to lead/bait Daniel into saying that he killed his uncle because he was mad about him destroying his things, Daniel's response was that he did not.

Rimmer: I had offered Daniel Carter a plea bargain with a 12 year cap and the defense could argue to the court for a lesser sentence. This was with Stokes another attorney.
The plea was turned down.
Now that Daniel has a new attorney I want to make sure he has discussed the plea with his attorney and fully understands.
Judge Terrell: Mr Carter do you understand that if you are convicted of this crime, I have no choice but to sentence you to Life in Prison without Parole?
Daniel Carter: Yes Sir
Judge Terrell: Have you had an opportunity to discuss this with your attorney?
Daniel Carter: Yes Sir
Judge Terrell: So you are saying you would like to proceed to trial then?
Daniel Carter: Yes Sir
Rimmer: For the record Judge, I withdraw the offer
This was devastating for Cindy, I can not even imagine what this must be like for her!!
I am sure it was a difficult decision to make... let me see..

(A) Admit guilt for something that is self defense, be sent away for 12 yrs
(possibly) be deemed an admitted murderer and felon for life even if one lives to see freedom since the kid would be sent to adult prison.
(B) Have Faith in human kind that a Jury will see the Truth and find him innocent of all charges ( in Pensacola)
Even if the Jury finds Daniel quilty of manslaughter (3rd degree) it is a mandatory 27 yrs I believe!
This is it, Daniel either wins or loses, no in between.

I just went on a world wind of a trip up to MJ's arraignment in Santa Maria, IN CHARACTER!
I got so much attention it was fabulous. Fans with
cameras, International media interviewing me, staying up all night, Michael showing up, the expected crowd frenzy, then over to Neverland . The fans we're
invited there on Friday afternoon. It was all truly surreal. I was getting
mistaken for him a lot, although never encountered him. His company saw me though, and put me on a "tape to Michael".
His Mom was being driven around the grounds, and mistook me for a moment! She leaned toward her driver and said "Is that Michael?" Then, the most
precious moment was at the zoo. A giraffe that was
all the way on the other side of the enclosure made a b-line toward me,(a guest said none of them were coming over.) I reached out my hand to the
fence, he sniffed it, threw his head back, and marched away. I couldn't fool his sniffer!
I have been on CNN Headline News, Fox News and CBS news that I know of.
For bad or good MJ is THE most talked about celebrity these days!

Please beware of this fake agent Al G of talent production assoc.

Do not let him talk you into going to NYC or meeting him in person.

He was arrested and charged with sexually assaulting models he conned into going to NYC.

He is out on bail and waiting trial on these charges.
